These Terms of Use ("Terms") govern your use of gymsinq.com (the "Website") and the Gymsinq gym management software (the "Service"), provided by Gymsinq ("Gymsinq", "we", "us"). By using the Website or the Service, you agree to these Terms. If you do not agree, please do not use them.
1. The Service
Gymsinq is web-based software that helps gym owners manage members, fees, attendance, staff, salaries, enquiries, expenses and reports. We may improve, change or add features to the Service over time.
2. Your account
- You must give us accurate information when you sign up and keep it up to date.
- You are responsible for keeping your login details safe and for everything that happens under your account, including actions by your staff.
- Tell us straight away if you think someone has used your account without permission.
3. Plans and payment
- Prices are shown on our pricing section and are in Pakistani Rupees (PKR).
- Fees are paid in advance for the billing period you choose.
- If a payment is not made on time, we may suspend access to the Service until it is paid.
- We may change our prices. Any change will apply from your next billing period, and we will tell you before it does.
- Refunds, if any, are given only as agreed with you in writing.
4. Your data
The information you enter into Gymsinq about your gym, members and staff belongs to you. You give us permission to store and process it only to provide the Service to you. You are responsible for collecting it lawfully and getting any consent you need from your members and staff, including for fingerprint attendance. Our Privacy Policy explains how we handle information.
5. Acceptable use
You agree not to:
- Use the Service for anything unlawful or to store information you have no right to hold
- Try to access accounts or data that are not yours
- Interfere with, damage or overload the Website or the Service
- Copy, resell or reverse engineer the Service
6. Our intellectual property
The Website, the Service, the Gymsinq name and logo, and all related software and content belong to Gymsinq. These Terms do not give you any ownership of them. You may use the Service only as these Terms allow.
7. Availability
We work to keep the Service running smoothly, but we do not promise it will always be available or free of errors. It may sometimes be unavailable for maintenance, updates or reasons outside our control.
8. Limitation of liability
The Service is provided "as is". To the extent the law allows, Gymsinq is not liable for any indirect or consequential loss, or for loss of profit, revenue or data, arising from your use of the Service. Our total liability to you for any claim is limited to the fees you paid us for the Service in the 12 months before the claim.
9. Ending your use
You may stop using the Service at any time. We may suspend or close your account if you break these Terms or do not pay fees that are due. If your account is closed, you can ask us for a copy of your data within a reasonable time afterwards.
10. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. If you keep using the Website or the Service after a change, you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of Pakistan. Any dispute will be subject to the jurisdiction of the courts in Karachi.
